Formal contract stipulations · Document Ref #TOU-2026
Standard commercial conditions, operational liability boundaries, and contractual obligations enforced by D&M Roofing across all project jurisdictions.
STATUS: ACTIVE // REVISED: OCTOBER 22, 2026 // VERSION: 4.2
D&M Roofing provides professional roof replacement, structural repairs, moisture membrane barriers, and commercial tear-off operations strictly pursuant to approved Work Authorizations. Every project execution follows certified architectural blueprints and local building ordinances. Additional structural work discovered during decking exposure requires an authorized change order before commencement.
All diagnostic reports, satellite pitch assessments, and site quotations remain contractually firm for exactly 30 calendar days from the date of issuance. Material cost escalations exceeding 8% occurring after the 30-day window will be recalculated to reflect current supply chain wholesale prices before formal crew dispatch.
D&M Roofing warrants all workmanship against water penetration and installation faults for a duration of 10 continuous years from final sign-off. Material defects (including shingles, TPO membranes, and flashing) are backed by original manufacturer guarantees. Warranties are voided by unauthorized third-party penetration, unapproved solar retrofits, or failure to perform documented annual gutter drainage maintenance.
We secure all required municipal building permits and schedule mandatory municipal code inspections. The client agrees to grant safe perimeter clearance of at least 15 feet around all structures during operations. In accordance with federal OSHA fall-protection regulations, work areas are restricted solely to authorized, certified roofing personnel while equipment is staged.
Contracts mandate a standardized 3-tier milestone structure: 30% mobilization deposit upon execution, 40% upon bulk material drop at site, and the 30% balance upon final inspection sign-off. Clients possess a statutory 72-hour right of rescission following signature. Cancellations initiated after custom material ordering incur a 15% restocking fee.
D&M Roofing maintains comprehensive commercial general liability and workers' compensation coverage. Severe meteorological occurrences (including sustained winds above 25 mph, thunderstorms, ice storms, or tropical depressions) mandate immediate emergency job pauses to safeguard personnel and open roof structures. Delay schedules resulting from severe weather do not constitute contract default.
Any contested dispute, claim, or breach arising under this agreement shall be settled through binding commercial arbitration administered by the American Arbitration Association in accordance with its Construction Industry Rules. Judgments rendered by the arbitrator may be entered in any court of competent jurisdiction. Both parties waive rights to class action consolidation.
